Wilmcote and Pathlow Neighbourhood Plan is now 'made'

Stratford-on-Avon District Council resolved that the Wilmcote and Pathlow Neighbourhood Development Plan was 'made' on 26 February 2018. It is now formally part of the District Council's development plan and will be used to assist in making decisions on planning applications within the plan area.

'Yes' vote at referendum

On Thursday 30 November 2017, voters in Wilmcote and Pathlow chose to say 'yes' to the Neighbourhood Plan.

  • 93.85% of those voting said 'Yes'
  • 351 people voted 'Yes' and 6.15% (23 people) voted 'No'
  • There was a 38.87% turnout

Plan to proceed to referendum

The Wilmcote and Pathlow Neighbourhood Development Plan (NDP) was independently examined between May and July of 2017. The examiner concluded that the NDP would meet the legal requirements set out in the Localism Act 2011, including meeting the basic conditions, subject to some modifications.

Our Cabinet voted on 9 October 2017 to proceed to referendum with the NDP, as amended by the modifications that are set out in the decision statement below.

Examination

Following completion of the formal submission consultation on the Submission Draft of the NDP, the plan - together with the associated consultation documents, schedule of responses and list of evidence base documents - was sent to the independent examiner in May 2017.

Formal Submission re-consultation

In accordance with Regulation 16 of the Neighbourhood Planning (General) Regulations 2012, as amended, we held a consultation on the policies proposed in the Submission version of the Plan. The consultation ran between 2 March and 14 April 2017.

This was the second time that the NDP had been through this process. The NDP was withdrawn from Examination in 2016 following the discovery that the plan had been prepared on the incorrect neighbourhood area boundary . Following the re-submission of a revised area designation application in November 2016, the plan proceeded through the statutory procedures with a view to returning to examination by the end of April 2017.

Pre-submission Draft Re-consultation

The Pre-Submission Draft of the Wilmcote and Pathlow Neighbourhood Plan was published for a six week period of consultation between 7 November 2016 and 21 December 2016 in accordance with Regulation 14 of the Neighbourhood Planning (General) Regulations 2012 (as amended).

This was the second time that the NDP had been through this process. Neighbourhood Area designation

The plan area for this NDP needed to be re-designated due to parish boundary changes. Wilmcote Parish Council was the relevant body that applied to the District Council for re-designation.
