Commercial Waste Management

Stratford-on-Avon District Council does not carry out any commercial waste collections. Businesses should not use the council's domestic collection service for their waste disposal requirements.

All businesses are under a Duty of Care for their waste under section 34 of the Environmental Protection Act 1990. This duty includes a requirement to only transfer waste to an authorised person and to transfer a written description of the waste to the person taking it.

There are a number of commercial waste collection companies operating in the area which can assist with the collection and disposal of general waste. There are also specialist companies offering recycling services, details of which can be found by searching online.

What are time banded collections?

Time banded collections means that businesses (and households) are only allowed to put their waste and/or recycling out for collection on the public highway at specific times of the day. In Stratford Town Centre, there will be a two-hour morning window of 7-9am (Mon-Sun), a two-hour early evening window of 5-7pm (Mon-Sun) and a one hour late evening window of 10-11pm (Mon-Sun) to coincide with trading hours.

Why are time banded collections being introduced?

Currently, bags, boxes or caddies can be presented for collection on the public highway at any time during a 24-hour period. This makes Stratford Town Centre appear dirty 
and untidy and increases the risk of bags being split open contributing to increased levels of litter, staining pavements and infestation. Time banded collections aim to improve local environmental quality by reducing the amount of illegally dumped rubbish and the time that bags, boxes and caddies are left out on the public highway, making the town centre more attractive. It also makes it easier for wheelchair and pushchair users as there are less obstructions on the public highway

collections from 1 April 2025:

Do time banded collections apply to bins or bags of waste only?

Both. All commercial waste and recycling presented for collection on the public highway must be contained within clearly identifiable sacks (not black sacks), bins or taped with words or logos identifying the waste collection provider and their contact details (e.g. telephone number).

Do the time banded windows apply if my waste and/or recycling is collected from within my premises (i.e. inside a loading bay or storage area)?

No. Your waste and/or recycling can be collected outside of the time banded windows if the bags or bins are stored within your premises.

What happens if I put my waste and/or recycling out on the public highway outside of the time banded windows?

Under Section 47 of the Environmental Protection Act 1990, the Council has powers to serve a statutory notice, whereupon failure to comply with its contents can result in the issuing of a Fixed Penalty Notice (FPN) for any waste and/or recycling presented on the public highway outside of the time banded windows, where evidence can support the identification of an alleged offender(s) breaching the regulations. The payment of a FPN discharges liability for the offence. Failure to pay the FPN or repeated offences may result in prosecution. Please note that there will be an initial 1-month grace period with regard to any formal enforcement action.

What happens if my waste collection provider fails to collect my waste and/or recycling during a time banded window?

If you notice that your waste and/or recycling has not been collected after the time banded window, you should bring it back into your premises and immediately contact your waste collection provider. They may have been delayed and can let you know when they will be arriving or provide you with alternative arrangements, such as using another time banded window or direct collection from within your premises.

My waste collection provider is unable to collect my waste and/or recycling within the time banded windows, what can I do?

The time banded windows provide a fair amount of flexibility. It is your responsibility to comply with the regulations, so you will need to use a waste collection provider who can collect in accordance with the scheme.

The following are options to consider:
* arrange for collections to take place from private land or property;
* arrange for a member of staff to be there to bring your waste and/or recycling out for collection at the correct time(s);
* change your collection time(s) with your waste collection provider;
* change your waste collection provider;
* contact other businesses who may have space on private land or property;
* think of ways to prevent, reduce or reuse your waste and appoint a green team 
or recycling champion; or
* use other businesses or circular economy initiatives that may have use for your 
waste.

Will the time banded windows still apply in the event of planned road closures within Stratford Town Centre?

The Council reserves the right to temporarily suspend the time banded windows only in those thoroughfares which are affected by special events (e.g. Christmas Markets, Mop Fairs) within Stratford Town Centre. This will be communicated via the Council's website and social media channels.
