A public inquiry starts on Tuesday 15 September, following an appeal by Mr Faron Cole after Stratford-on-Avon District Council refused to grant a certificate of lawfulness.

The appeal relates to the refusal to grant a certificate of lawfulness of existing use or development for establishing the extent of residential curtilage for land at Wrens Nest, Sambourne Lane, Sambourne, Redditch, B96 6PL.

Stratford-on-Avon District Council refused to grant a certificate of lawfulness as it was not satisfied on the balance of probabilities, based on the evidence submitted and evidence provided by third parties together with the District Planning Authority's own records, that the land has been used for residential purposes for a period of ten years or more,

The inquiry, expected to last for 1 day, will be held at the Council Offices, Elizabeth House, Church Street, Stratford-upon-Avon starting at 10am.  A Government Planning Inspector will preside over the inquiry.  The Inspector's Reference is: APP/J3720/X/09/2094101.

Members of the public may attend the inquiry and express their view at the discretion of the inspector.
