Court case ruling on York Farm Barn, Ilmington

Solihull Magistrates Court awarded Stratford-on-Avon District Council £5,515 costs following a recent prosecution brought after a Listed Building in Ilmington was altered without Listed Building Consent. Property owner Michael Bancroft of Ilmington and architectural consultant John Bradley of Shipston-on-Stour were both found guilty and fined £3,000 each.

Mr Bancroft and Mr Bradley carried out unauthorised works to a Grade II listed building, York Farm Barn at Ilmington, Warwickshire by cutting through the beams of five trusses without having obtained listed building consent from the Local Planning Authority contrary to the Planning (Listed Buildings and Conservation Areas) Act 1990.

Stratford District Council is still to agree the remedial works necessary at York Farm Barn that will help restore the architectural features and Historic fabric of the Listed Building.

"This case recognises the importance of protecting our District heritage and the need to comply with planning rules," says Councillor Gillian Roache, Planning Portfolio.

"People who continue to break these rules and threaten the character of the District risk legal action and significant penalties and this case should act as warning to owners, agents and builders who wish to attempt to destroy our heritage."

John Bradley sold his business to individuals who are trading as John Bradley Associates Ltd of Shipston and the District Council would like to point out that they have no connection with the conviction.
