Limitations of E-Planning

Our online planning applications system (E-Planning) is available via the council's website between 06:00 and 00:00 (midnight) daily. The service continues to be developed, but at the present time no constraint information is available online. Please contact our offices for details of constraints that may apply, such as Tree Preservation Orders. Details about previous planning applications are currently provided from 1974 onwards.

The online planning history for any particular site at present is incomplete and should not be relied upon in connection with a property transaction. Anyone wishing to obtain planning information for this purpose is advised to carry out a local land charges search through the council's Land Charges service or the National Land Information Service (NLIS) using one of the official licensed channels. No responsibility will be taken for any errors or omissions in the planning history information obtained from E-Planning. Similarly, the information contained within E-Planning does not constitute in any way a formal notification of a planning decision, and as such any actions taken as a result of information displayed on the site are undertaken entirely at the viewer's own risk.

Under normal circumstances new planning application information will be able to be viewed within five working days of the application being validated. If this is not available you may wish to try a few days later, or alternatively you will be able to view the planning application information, in addition to the plans and associated documents, at Elizabeth House, Church Street, Stratford-upon-Avon.

Stratford-on-Avon District Council reserves the right to remove or not display certain planning application information for confidentiality or other reasons. This may include sensitive personal or financial information or documents containing details of protected species. It also includes the telephone number, email address and signatures of applicants.

Commenting via E-Planning

Stratford-on-Avon District Council encourages public participation in planning and your views and comments on planning applications are welcomed.

If you or any other person wishes to make representations on an application, either just to comment or in support or objection to an application, you can do this via the E-Planning system.

When the planning application details are selected in the E-Planning system, a Comment tab appears in the top right corner; click on this and follow the instructions. Please note this only appears for applications that are current and fall within the valid publicity period.

Alternatively you can email your comments to planning.applications@stratford-dc.gov.uk or send them in the post, within the three week statutory publicity period.

When making representations please only provide information (including personal details) which you are happy for other people to view.

If you do not want your comments to appear on the council's website, they will be treated as anonymous. Anonymous representations will usually be given less weight in the determination of a planning application. Read more about how we manage your personal data during the planning application process.

What issues can I refer to when making representations?

When considering an application, the council has to balance people's rights to use or develop their property against public interests and concerns. To do this we carefully weigh all material considerations. These include:

  • Stratford-on-Avon Core Strategy
  • government guidance
  • case law and previous decisions
  • effect on the enjoyment of neighbouring properties
  • design, appearance and layout
  • conservation of the built and natural environment
  • highway safety and traffic

The following are irrelevant in reaching planning decisions and therefore cannot be taken into account:

  • loss of view over other people's land
  • effect on the value of property
  • possible future development
  • developer's motives
  • private property rights (e.g. boundaries or access)
  • matters covered by other laws, e.g. alcohol licences

Planning application information submitted to the council is protected by the Copyright Acts (Section 47, 1988 Act). You may only use material which is downloaded and / or printed for consultation purposes, to compare current applications with previous schemes and to check whether developments have been completed in accordance with approved plans. Further copies must not be made without the prior permission of the copyright owner.

If you access E-Planning you have acknowledged that you have read, understood and agree to the copyright and other limitations.
