Misuse of Disabled Badges
Section 94 of the Traffic Management Act 2004 gives authorised officers powers to inspect Blue Disabled Badges. Authorised officers can be police officers or a civil enforcement officer.
Misuse of a Blue Badge is a serious offence. The only time that someone else may use the badge, without the holder being in the vehicle, is if they are dropping off or picking up the badge holder.
Offences can be broken down into at least three broad categories;
- The holder deliberately misusing the badge
- A person other than the badge holder misusing the badge
- A person using a stolen or fraudulently altered badge or a fraudulently created document designed to look like a badge
