The Local Government (Miscellaneous Provisions) Act, 1982, Section 29, gives the Council the power to serve notice with regard to unoccupied buildings, or buildings where the occupier is temporarily absent, if the building is not effectively secured against unauthorised entry or is likely to become a danger to public health.
The notice is served on each owner or occupier of the building specifying the works the Council proposes to undertake for the purpose of preventing unauthorised entry or preventing it from becoming a danger to public health. Specified works cannot be undertaken within 48 hours of serving the notice, however a notice need not be served when the Council considers it necessary to undertake the works immediately.
The Council may recover the expenses reasonably incurred in undertaking the specified works.
