The Clean Air Act 1993, Section 14, requires that a chimney height approval is obtained from the local authority where an occupier of a building uses a furnace to burn:
a) pulverised fuel; or
b) any other solid matter at a rate of 45.4 kilograms or more per hour; or
c) any liquid or gaseous matter at a rate equivalent to 366.4 kilowatts or more.
The local authority may impose conditions on any approval given and the occupier may not knowingly cause or permit the furnace to be used unless the height of the chimney serving the furnace has been approved and any conditions subject to which the approval was granted are complied with.
It is an offence if, on any day, a person having possession of any boiler or plant contravenes the above. A person guilty of an offence is liable to a fine not exceeding £20,000.
