Sex Establishments

A Licence is required for a sex cinema or a sex shop. A sex cinema means any premises, vessel, vehicle or stall used to a significant degree for the exhibition of moving pictures, however produced, which are concerned primarily with sexual activity.

Sex shop means any premises, vehicle vessel or stall used for a business which consist to a significant degree of selling, hiring, exchanging, lending, displaying or demonstrating sex articles or other things intended for use in connection with or for stimulating or encouraging sexual activity or acts of force or restraint which are associated with sexual activity.

Sex articles means anything for use in connection with or for stimulating or encouraging sexual activity or acts of force or restraint, which are associated with sexual activity.

A Licence is not required for the sale, supply or demonstration of birth control items.

Who can make an application

The appropriate Authority may grant to any applicant, a Licence, for the use of any premises, vehicle, vessel or stall specified in it for a sex establishment.

To whom can a Licence not be granted?

  • A person under eighteen.
  • A person who has held a Licence but it has been revoked.
  • To a person, other than a body corporate, who is not resident in the United Kingdom or was not so resident before the application.
  • A body corporate which is not incorporated in the United Kingdom.
  • A person who had within twelve months preceding the date of the application been refused a Licence.

How is the application made?

  • The application must be in writing.
  • An application made by an individual shall give their full name, permanent address and age.
  • An application made by a limited company or unincorporated body must state the name of the organisation, the address of registered or principal office and the full names and private address of the directors or other persons responsible for its management.
  • In both cases the application must give the full address of the premises or state where the vehicle, vessel or stall is to be used.
  • Notice must also be given of the application in the local press, the notice to appear not later than seven days after the application. Finally, notice of the application must be displayed for twenty-one days, beginning with the date of the application, on or near the premises.
  • Within seven days of making the application to the Authority a copy of the application must be sent to the Police.

A Licence will remain in force provided an application for renewal is made before the old Licence expires. Similarly, an application to transfer may be made and the Licence will continue until the matter has been determined.
